Legislator Greg McCollough offers the following:

 

WHEREAS, in order to participate in certain county administered human services programs or to meet court mandated program requirements, it may be necessary to administer standardized drug testing for program participants; and

 

WHEREAS, in order to accurately test for evidence of recent drug or alcohol use, a variety of drug testing kits that can detect illegal or prohibited drug use, prescription medications, over-the-counter medicines and legal substances such as alcohol and tobacco are administered; and

 

WHEREAS, Ulster County utilizes contractual agreements for professional services with third party organizations in the delivery of these services; and

 

WHEREAS, accuracy of drug screening can be attributed to the quality or type of drug test kit used, with inferior kits more likely to present false positive outcomes; now, therefore, be it

 

RESOLVED, that it shall be the policy of Ulster County that a component of any contractual agreement with the county for these screening services shall require that all field drug test kits allowing trace and bulk detection be the best and most accurate test kit for narcotics and other drugs to ensure that false positive tests are significantly reduced and/or eliminated; and, be it further

 

RESOLVED, should any individual receive positive results on an initial drug test, administration of a secondary test of any brand shall be offered without delay to ensure that the false positive does not exist,

 

and moves its adoption.
