Committee, David B. Donaldson, and Deputy Chairman Mary Wawro offer the

following:

WHEREAS, pursuant to Section 224, Subdivision 8 of the County Law, the

Ulster County Legislature appropriated to Cornell Cooperative Extension Association

of Ulster County the sum of $312,475.00 in the 2014 Ulster County Budget to be

expended in accordance with budgets submitted to the Ulster County Legislature; and

WHEREAS, pursuant to County Law Section 224 (8), in order to receive such

funds, Cornell Cooperative Extension Association of Ulster County must submit to

the Ulster County Legislature a verified accounting of disbursements to be

undertaken, and to the Ulster County Commissioner of Finance, a Memorandum of

Receipt signed by the principal officer; and

WHEREAS, Cornell Cooperative Extension Association of Ulster County will

receive payment in the amount of $312,475.00, in accordance with the terms

specified in an agreement with the County of Ulster and Cornell Cooperative Extension Association of Ulster County and will return any unexpended funds as of

December 31, 2014, along with a certified accounting of expenditures to the

Commissioner of Finance; now, therefore be it

RESOLVED, Cornell Cooperative Extension Association of Ulster County

shall render a true and accurate report of its operations for the year 2013 prior to the

release of any authorized funds; and, be it further

RESOLVED, that the Commissioner of Finance be and hereby is authorized

and directed to pay such funds in equal quarterly installments due on the first day of

each period, or in such other manner as may be agreed upon by the parties hereto to

Cornell Cooperative Extension Association of Ulster County; and, be it further

RESOLVED, that as part of the agreement, the Comptroller and/or any and all

officers of the County of Ulster, their agents and representatives, shall be allowed full

access upon reasonable notice and at reasonable times to the books, papers,

records and premises of Cornell Cooperative Extension Association of Ulster County

during the period that this Resolution is in effect for the purpose of ascertaining the

manner in which the above sum of money is being used or applied; and, be it further

RESOLVED, that the above organization agrees to comply with all applicable

Federal, State and local regulations including, in particular, any forbidding

discrimination by such organization; and, be it further

RESOLVED, that as part of the agreement, the Chairman of the Ulster County

Legislature is hereby authorized to sign a memorandum of agreement (subject to the

approval of the County Attorney as may be duly approved by Cornell University as

agent for the State of New York, outlining the above conditions and methods of

payment and directing the above Association to spend the funds only for the purpose

set forth herein; requiring an annual report at the end of the year containing therein a

true and accurate account of all receipts and expenditures of said association) and an

agreement for professional services in the amount of $312,475.00 with the County of

Ulster and Cornell Cooperative Extension Association of Ulster County, in the

form as filed with the Clerk of the Ulster County Legislature or as modified with the

approval of the County Attorney, Counsel to the County Legislature, Chairman of the

County Legislature, and the Chairman and Deputy Chairman of the Legislative

Programs, Education and Community Services Committee,

and move its adoption.
