Chairman of the ARPA Special Committee, Peter J. Criswell, and Deputy Chair Thomas Corcoran, Jr. offer the following:

WHEREAS, this resolution has been submitted at the request of the County Executive on behalf of the Department of Finance, Division of Recovery and Resilience; and

WHEREAS, the Ulster County Legislature passed Resolution No. 96 in April 2022 amending and funding Capital Project No. 604 in the amount of five million dollars ($5,000,000.00) to create a program to partner with Ulster County municipalities and match up to 33% of water and sewer projects with a maximum contribution of $500,000.00 per project;

WHEREAS, the County and the Town of Lloyd (the “Town”) desire to enter into an Intermunicipal Agreement (IMA) where the Town of Lloyd will be a subrecipient of Five Hundred Thousand Dollars ($500,000.00) of American Rescue Plan Act – Coronavirus State and Local Financial Recovery Funds (SLFRF); and

WHEREAS the Town will be responsible under the IMA for administering a program to complete the replacement of its municipal water storage tank at Thomas Rizzo Boulevard (Reservoir Road) in the Town of Lloyd; now, therefore be it

RESOLVED, the Chair of the Ulster County Legislature is hereby authorized to execute the Inter Municipal Agreement with the Town of Lloyd to partially fund the replacement of a water storage tank in the form as filed with the Clerk of the Legislature or as modified with the approval of the County Attorney,

and move its adoption.
