Chairwoman of the Public Works, Capital Projects and Transportation Committee, Laura Petit, and Deputy Chair Dean J. Fabiano offer the following:

 

WHEREAS,thisResolutionhasbeensubmittedat the request oftheCountyExecutiveonbehalfoftheDepartmentofPlanning;and

 

WHEREAS,aProjectfortheKingstonRailTrail,PIN8758.04,toconstructanapproximately1.8mileshared-usepath(“railtrail”)connectingtheHurley(O&W)RailTrailintheTownofHurleytoWashingtonAvenueintheCity of Kingston (the“Project”)iseligibleforfundingunderTitle23U.S.Code,asamended,thatcallsfortheapportionmentofthecostsofsuchprojecttobeborneattheratioof80%federalfundsand20%non-federalfunds;and

 

WHEREAS,CapitalProjectNo.334-KingstonRailTrail-wasestablishedpursuanttoResolutionNo.58ofMarch16,2010, wasamendedpursuanttoResolutionNo.291ofAugust19,2014,toprovideauthorizationandfundingforengineeringandright-of-wayincidentalsworkfortheProjectin  theamountof $245,000.00, and amended pursuant to Resolution No. 276 of June 19, 2018 for additional funding for right of way in the amount of $60,000.00, and amended  pursuant to Resolution No. 455 of September 19, 2022 to provide funding for construction in the amount of $2,811,000.00 of which $335,305.00 was required for construction inspection;and

 

WHEREAS, the Ulster County Legislature in approving the increase in funding as provided for in the above cited resolutions approved and agreed to advance the Project by committing 100% of the federal and non-federal shares of the cost of for construction and construction inspection and additional design costs pursuant to  work in the first instance; and

 

 

 

 

 

WHEREAS,theUlsterCountyLegislatureadoptedResolutionNo.168onMarch15,2016pursuantto6NYCRRPart617etseq.oftheRegulationsofArticle8oftheEnvironmentalConservationLawofNewYorkState(hereinafter“SEQRA”)therebyadoptingandissuingadeterminationofnon-significanceunderSEQRA(hereinafterthe“NegativeDeclaration”);and

 

WHEREAS,UlsterCountydesirestoadvancetheProjectbymakingacommitmentof100%ofthefederalandnon-federalshareofthecostsof construction and construction inspection as well as increased costs the cost of construction for theProject;and

 

WHEREAS, the Planning Director requests that Capital Project No. 334 be amended and funded for $605,235.00 for a total project cost of $3,867,235.00; now, therefore be it

 

RESOLVED,theUlsterCountyLegislatureherebyapprovesthefurtherprogressoftheabove-subjectProjectforthe construction phase of the project;and,beitfurther

 

RESOLVED,thatthe UlsterCountyLegislatureherebyauthorizesUlsterCountytopayinthefirstinstance100%ofthefederalandnon-federalshareofthecostoftheconstruction phase fortheProjectorportionsthereof;and,beitfurther

 

RESOLVED,thatintheeventthefullfederalandnon-federalsharecostsoftheProjectexceedstheamountappropriatedabove,theUlsterCountyLegislatureshallconveneassoonaspossibletoappropriatesaidexcessamountimmediatelyuponthenotificationbytheUlsterCountyExecutivethereof;and,beitfurther

 

RESOLVED,thattheChairoftheUlsterCountyLegislaturebeandisherebyauthorizedtoexecuteallnecessaryAgreements,certificationsandreimbursementrequestsforfederalaidonbehalfofUlsterCountywiththeNewYorkStateDepartmentofTransportation(“NYSDOT”)inconnectionwiththeadvancementorapprovaloftheProjectandprovidingfortheadministrationoftheProjectandtheCounty’sfirstinstancefundingofProjectcostsandpermanentfundingofthelocalshareoffederalaideligibleProjectcostsandallProjectcostswithinappropriationsthereforethatarenotsoeligible;and,beitfurther

 

 

RESOLVED,thatinadditiontotheChairoftheUlsterCountyLegislature,thefollowingmunicipaltitles--DirectorofPurchasing,DirectorofPlanning,andDeputyDirectorofPlanning—arealsoherbyauthorizedtoexecuteanyAgreements,certifications,andreimbursementrequestsonbehalfoftheCountywithNYSDOTinconnectionwiththeadvancementorapprovaloftheProjectidentifiedintheFederal-AidLocalProjectAgreement;and,beitfurther

 

RESOLVED,thattheUlsterCountyCommissionerofFinanceisauthorizedtomakepaymentsassociatedwithconstruction phase of the project;and,beitfurther

 

RESOLVED,thatacertifiedcopyofthisResolutionwillbefiledwiththeNewYorkStateCommissionerofTransportationbyattachingittoanynecessaryAgreementinconnectionwiththeProject;and,beitfurther

 

RESOLVED, that the 2023-2028 Ulster County Capital Improvement Program is amended as follows:
