Referred to: The Energy, Environment and Sustainability Committee (Chairwoman Greene and Legislators Hansut, Erner, Maloney, and Stewart), and The Ways and Means Committee (Chairman Gavaris and Legislators Cahill, Fabiano, Ronk, and Walter)
Legislators Laura Petit and Joe Maloney offer the following:
WHEREAS, Local Law Number 8 of 1991 entitled “Ulster County Mandatory Source Separation And Recycling Law” created, established and authorized an independent administrative hearing officer to issue orders assessing civil penalties for violations of this local law; and
WHEREAS, Local Law Number 8 of 1991, after subsequent amendments was codified into §304 of the Code of the County of Ulster; and
WHEREAS, pursuant to §304-25 of the Code of the County of Ulster, the independent administrative hearing officer shall be appointed by the County Legislature to serve at the pleasure of the County Legislature; and
WHEREAS, the Administrative Hearing Officer shall have the power and authority as specified or limited by the local law and/or New York State statute; now, therefore be it
RESOLVED, that TBD is hereby appointed as Independent Administrative Hearing Officer, pursuant to §304-25 of the Code of the County of Ulster, to serve at the pleasure of the Ulster County Legislature,
and move its adoption.
