Chairwoman of the Law Enforcement and Public Safety Committee, Eve Walter, and Deputy Chair Heidi Haynes offer the following:

 

WHEREAS, for reasons not ascribable to their own negligence, Ulster County Deputy Sheriffs Kyle Frano, Joseph Sciutto, and Emmett Vedder, III failed to make a timely application to participate in the optional twenty-year retirement plan established pursuant to Section 552 of the Retirement and Social Security Law; and

 

WHEREAS, legislation was introduced, as Senate Bill No. S4343 and Assembly Bill No. A6725, to allow Ulster County to elect to reopen the provisions of Section 552 of the Retirement and Social Security Law for the three above mentioned employees to join the optional twenty-year retirement plan, and a formal Home Rule Request was approved by the Ulster County Legislature pursuant to Resolution No. 191, dated April 20, 2021; and

 

WHEREAS, said New York State legislation has been signed as a chapter of law, granting the County of Ulster authority to reopen Section 552 of the Retirement and Social Security Law; and

 

WHEREAS, the County wishes to proceed with reopening the law for the three above mentioned employees to join the optional twenty-year retirement plan; now, therefore be it

 

RESOLVED, that the governing board of the County of Ulster does hereby elect to reopen Section 552 of the Retirement and Social Security Law, pursuant to Chapter 531 of the Laws of 2021,

                                                                                       

and move its adoption.
