Chairwoman of the Law Enforcement and Public Safety Committee, Eve Walter, and Deputy Chair Heidi Haynes offer the following:

 

WHEREAS, for reasons not ascribable to their own negligence, Ulster County Deputy Sheriffs Kyle Frano, Joseph Sciutto, and Emmett Vedder, III failed to make a timely application to participate in the optional twenty-year retirement plan established pursuant to Section 552 of the Retirement and Social Security Law; and

 

WHEREAS, legislation was introduced in 2020, as Senate Bill No. S8546 and Assembly Bill No. A10616, to allow Ulster County to elect to reopen the provisions of Section 552 of the Retirement and Social Security Law for the three above mentioned employees to join the optional twenty-year retirement plan, and a formal Home Rule Request was approved by the Ulster County Legislature pursuant to Resolution No. 267, dated August 18, 2020; and

 

WHEREAS, said Home Rule Request was not honored in 2020, and as such new legislation has now been introduced as Senate Bill No. S4343 and Assembly Bill No. A6725, and a formal Home Rule Request requesting enactment of this legislation is now appropriate; now, therefore be it

 

RESOLVED, that the County Executive and/or the Clerk of the Ulster County Legislature are hereby authorized to execute and submit a Home Rule Request (Request by a Local Government for Enactment of a Special Law), pursuant to Article IX of the Constitution, requesting the enactment of Senate Bill No. S4343 and Assembly Bill No. A6725 entitled “An act to authorize the county of Ulster to offer an optional twenty year retirement plan to certain deputy sheriffs employed by such county,

                                                                                       

and move its adoption.
