Referred to: The Legislative Programs, Education and Community Services Committee (Chairman Delaune and Legislators Corcoran, Criswell, Parete, and Wawro), and The Ways and Means Committee (Chairwoman Archer and Legislators Bartels, Gavaris, Haynes, Maio, Ronk, and Walter)
Chairman of the Legislative Programs, Education and Community Services Committee, James Delaune, and Deputy Chair Thomas Corcoran, offer the following:
WHEREAS, performing arts are an important component of our cultural heritage, and the many performances arranged by the Ulster Performing Arts Center (UPAC LLC) attract Hudson Valley residents as well as travelers to see a broad range of entertainment for the community; and
WHEREAS, pursuant to County Law Section 224 (13), the Ulster County Legislature appropriated to UPAC LLC the sum of $24,750.00 in the 2020 Ulster County Budget for operations; and
WHEREAS, pursuant to County Law Section 224 (13), in order to receive such funds, UPAC LLC must submit to the Ulster County Legislature a verified accounting of disbursements to be undertaken, and to the Legislative Financial Analyst and Commissioner of Finance, a Memorandum of Receipt signed by the principal officer; and
WHEREAS, UPAC LLC will receive payments totaling the not to exceed amount of $24,750.00 $12,375.00, in accordance with the terms specified in an agreement with the County of Ulster and UPAC LLC, and no later than December 31, 2020, UPAC LLC shall submit a certified accounting of expenditures to the Legislative Financial Analyst and Commissioner of Finance; now, therefore, be it
RESOLVED, that the Chair of the Ulster County Legislature is hereby authorized to execute an agreement in the amount of $24,750.00 $12,375.00 with UPAC LLC, for various operational expenses that allow Ulster Performing Arts Center to provide programming for Ulster County residents, in the form as filed with the Clerk of the Ulster County Legislature or as modified with the approval of the County Attorney, Counsel to the County Legislature, Chair of the County Legislature, and the Chair and Deputy Chair of the Legislative Programs, Education and Community Services Committee; and, be it further
RESOLVED, that the Comptroller and/or any and all officers of the County of Ulster, their agents and representatives, shall be allowed full access upon reasonable notice and at reasonable times to the books, papers, records and premises of UPAC LLC, during the period that this resolution is in effect for the purpose of ascertaining the manner in which the above sum of money is being used or applied; and, be it further
RESOLVED, that the above organization agrees to comply with all applicable Federal, State and local regulations including, in particular, any forbidding discrimination by such organization;
and move its adoption.
