Chairman of the Public Works and Capital Projects Committee, Dean J. Fabiano, and

Deputy Chair Manna Jo Greene offer the following:

 

WHEREAS, this resolution has been submitted by the County Executive on

behalf of the Department of Public Works – (Highways & Bridges); and

WHEREAS, the 2018-2023 Ulster County Capital Improvement Plan included

funding of $1,880,000.00 for the reconstruction of the Frost Valley S-turn; and

WHEREAS, Capital Project No. 504 in the amount of $230,000.00 was

established pursuant to Resolution No. 267, dated June 20, 2017, for construction

inspection and land acquisitions; and

WHEREAS, the design has identified the land acquisition needs consisting of

two (2) temporary easements and one (1) permanent easement to construct the

project; and

WHEREAS, owners of the lands associated with those real property interests

have been contacted, are aware of the Project, and in order to allow the project to

move forward, will be provided just compensation for the conveyance of real

property to the County to allow for the project; and

WHEREAS, this Project constitutes an Unlisted Action of the State

Environmental Quality Review Act (SEQRA) and shall be progressed as such in

accordance with 6 NYCRR Part 617 of SEQRA, requiring further determination or

procedure under SEQRA; now, therefore, be it

RESOLVED, the Ulster County Legislature hereby authorizes the Chairman

of the Ulster County Legislature to execute, on behalf of the County of Ulster, any

and all documents related to the land acquisitions as approved by the County

Attorney; and, be it further

RESOLVED, that the Ulster County Commissioner of Finance is authorized

to make payments associated with the land acquisitions needed for the project, from

the funding for Land Acquisitions, 

 

and move its adoption.
