Chairman of the Public Health and Social Services Committee, Craig V. Lopez, and

Deputy Chairman Chris Allen offer the following:

WHEREAS, this resolution has been submitted by the County Executive on

behalf of the Department of Social Services; and

WHEREAS, one of the functions of the Ulster County Department of Social

Services, through its Child Protective Services unit, is to investigate child abuse and

maltreatment reports and to protect children under the age of eighteen from further

abuse or maltreatment; and

WHEREAS, access to criminal history record information compiled and

maintained by the Division of Criminal Justice Services is permitted under New York

State law as part of the Child Protective Services unit investigation of individuals

named in a report of suspected child abuse or of adult individuals living in the home

of a child suspected of being abused or maltreated; and

WHEREAS, the Commissioner of Department of Social Services requests that

the Chairman of the Ulster County Legislature be authorized to execute a Use and

Dissemination Agreement, and any amendments, thereto, with the New York State

Division of Criminal Justice Services; now, therefore, be it

RESOLVED, that the Chairman of the Ulster County Legislature is authorized

to execute a Use and Dissemination Agreement, and any amendments thereto, with

the New York State Division of Criminal Justice, in the form as files with the Clerk

of the Ulster County Legislature or as modified with the approval of the County

Attorney,

and move its adoption.
