Chairman of the Law Enforcement and Public Safety Committee, Thomas J. Briggs,

and Deputy Chairman Kenneth J. Ronk offer the following:

WHEREAS, this resolution has been submitted by the County Executive on

behalf of the Public Defender; and

WHEREAS, the Public Defender has requested that the Chairman of the

Ulster County Legislature be authorized to execute an agreement (NYS Contract#

C000451), and any amendments thereto, in the amount of $604,776.00 with the New

York State Office of Indigent Legal Services for the purpose of Ulster County’s

participation in the Counsel at First Appearance Project for the term June 1, 2013

through May 31, 2016; and

WHEREAS, the purposes of the Counsel at First Appearance project are to:

(1) make demonstrable and measureable improvements in the delivery of indigent

defense services to eligible persons at a defendant’s first appearance before a judge,

(2) provide effective representation of indigent persons at their first appearance and

promote continuous representation of such persons, and (3) comply with current New

York law requiring the representation of individuals’ first appearance before a judge;

now, therefore, be it

RESOLVED, that the Chairman of the Ulster County Legislature is hereby

authorized to execute an agreement, and any amendments thereto, in the amount of

$604,776.00 with the New York State Office of Indigent Legal Services for the

purpose of Ulster County’s participation in the Counsel at First Appearance Project

for the term June 1, 2013 through May 31, 2016, in the form as filed with the Clerk

of the Ulster County Legislature, or as modified with the approval of the County

Attorney and Chairman of the Ulster County Legislature,

and move its adoption.
