Chairman of the Public Works & Capital Projects Committee, Dean J. Fabiano,

and Deputy Chairman Peter M. Loughran offer the following:

WHEREAS, this resolution has been submitted by the County Executive on

behalf of the Department of Public Works; and

WHEREAS, the Town of Wawarsing was the recipient of a grant from the

New York State Department of Transportation to construct a terminal building at the

Joseph Y. Resnick Airport, Ellenville, NY; and

WHEREAS, the grant required that a portion of the terminal building be

occupied by a police/security agency; and

WHEREAS, the Ulster County Sheriff’s Office has maintained a substation in

a portion of the airport terminal building, occupying 1,534 square feet of space at no

rental cost, but is responsible for the payment of all utilities for the occupied space;

and

WHEREAS, the lease agreement for the Ulster County Sheriff’s substation at

the airport will expire on April 30, 2015; and

WHEREAS, the lease provides the County with the right and option to renew

the lease, for an additional five year term, commencing May 1, 2015 through April

30, 2020, at the same terms and conditions as the present lease agreement; and

WHEREAS, the Acting Commissioner of Public Works has requested that the

Legislature approve exercising the option to renew the lease agreement with the

Town of Wawarsing, for the continued use of office space for the Ulster County

Sheriff’s Office substation at the Joseph Y. Resnick Airport terminal building at no

rental cost; and

 

WHEREAS, in any event, the tenant, the County of Ulster, shall have the

option to terminate the lease for any reason or for no reason, upon sixty (60) days

written notice to the landlord; now, therefore, be it

RESOLVED, that the Chairman of the Ulster County Legislature is hereby

authorized to execute a lease, and any amendments thereto, with the Town of

Wawarsing for the continued use of office space for an Ulster County Sheriff’s

Office substation at the Joseph Y. Resnick Airport terminal building at no rental cost,

in the form as filed with the Clerk of the Ulster County Legislature;

and move its adoption.
