Legislator Lynn Archer and Legislators Loughran and Provenzano offer the

following:

WHEREAS, the Rules of Order of the Ulster County Legislature adopted on

January 7, 2014, and amended on June 17, 2014, were crafted through the Ulster

County Legislature’s Committee process, in a bi-partisan, transparent manner; and

WHEREAS, since adoption, situations have arisen that demonstrate the need

for clarification in certain sections of said Rules of Order; and

WHEREAS, the Ulster County Legislature believes that in order to more

effectively and fairly operate the policy making branch of government, it has become

necessary to amend said Rules of Order; now, therefore, be it

RESOLVED, that RULE 3. RESOLUTIONS, LOCAL LAWS, RULES FOR

PROCEDURE FOR PRESENTATION AND CONSIDERATION; E. Petition to

Discharge; (c) is hereby amended as follows:

“(c) Thereafter if Legislators shall sign the Petition to Discharge, as described

above, the Resolution shall be referred to the next full meeting of the County

Legislature for a vote provided such full meeting is at least ten days from the date the

minimum number of signatures needed pursuant to these Rules have been made upon

(or with the authorization of the Legislator placed upon) the Petition to Discharge.

The Resolution discharged may be adopted, defeated, or referred back to

Committee. If the previously discharged Resolution is referred back to

Committee and defeated therein and a second Petition to Discharge is

successfully executed, the Resolution shall only be subject to a vote to adopt or

be defeated.”; and, be it further

RESOLVED, that RULE 7. RULES FOR COMMITTEES; C. is hereby

amended as follows:

“C. An agenda of all matters before a committee shall be prepared by the

Clerk of the Legislature upon request of the Chairperson of a Committee. The

Agenda of all Committee meetings must include all Regular Resolutions

referred to said committee that were filed in accordance with the Rules of Order

of the Legislature, unless all Sponsors of the Regular Resolution request it be

referred to a later meeting of the Committee.”; and, be it further

 

RESOLVED, that these Rule changes shall take effect upon an affirmative

vote of this body subsequent to two consecutive readings,

and move its adoption.
