Chair of the Public Works and Capital Projects Committee, Kathy Nolan, and Deputy Chair Herbert Litts, III offer the following:
WHEREAS,thisresolutionhasbeensubmittedattherequestoftheCountyExecutiveonbehalfoftheDepartmentofPublicWorks;and
WHEREAS,thecountyissuedRFB-UC24-148C forConstructionservicesfortheGovernmentOperationsBuilding;and
WHEREAS, pursuant to Resolution No. 444 of October 19, 2021 the Ulster County Legislature established Capital Project No. 607 Government Operations Center in the amount of $1,353,624.00 and provided funding for architectural & engineering services; and
WHEREAS, pursuant to Resolution No. 308 of November 15, 2022 Ulster County declared its intent to act as Lead Agency under 6 NYCRR Part 617.6(b) (3) of the Regulations pertaining to Article 8 of the Environmental Conservation Law of New York State (SEQRA) for the purchase lands at Paradies Lane to be utilized for the construction of Government Operations Center and hearing no objections assumed Lead Agency after thirty (30) of said notice being issued; and
WHEREAS, Capital Project No. 607 was amended pursuant to Resolution No. 309 of November 15, 2022, in the amount of $3,000,000.00, upon the Ulster County Legislature’s authorization of the acquisition of real property located at Paradies Lane in the Town of New Paltz for the purposes of siting the Government Operations Center for a total cost of $4,353,624.00; and
WHEREAS, pursuant to Resolution No. 675 of December 19, 2022 the Ulster County Legislature amended Capital Project No. 607 in the amount of $365,500.00 to provide additional funding related to site selection, and additional environmental work including testing associated with both the design of the Project and environmental concerns related to the brownfield areas of the project site for a total cost of $4,719,124.00; and
WHEREAS, pursuant to Resolution No. 364 of December 18, 2023 a Restricted Capital Reserve was established for the Government Operations Center (“the Fund”) in the amount of $18,000,000.00; and
WHEREAS, pursuant to Resolution No. 364 of December 18, 2023, monies in the Fund may be appropriated to finance any object or purpose for the construction, reconstruction, or acquisition of Capital Project No. 607 – Government Operations Center for which bonds may be issued; and
WHEREAS, an expenditure shall be made from the Fund only by authorization of the Legislature for the Government Operations Center; and
WHEREAS, pursuant to Resolution No. 754 of December 18, 2023, the Ulster County Legislature approved a Project Labor Agreement to use a Project Labor Agreement for Capital Project No. 607, the Ulster County Government Operations Center based on projected labor cost savings and the noneconomic public benefits likely to accrue and contribute to the Project success; and
WHEREAS, pursuant to Resolution No. 319 of June 18, 2024 the Ulster County Legislature amended Capital Project No. 607 in the amount of $571,650.00 to provide funding related to environmental work with both the design of the Project and environmental concerns related to the brownfield areas of the project site for a total cost of $5,290,774.00; and
WHEREAS, pursuant to Resolution No. 632 of December 17, 2024 the Ulster County Legislature adopted and issued a Negative Declaration under 6 NYCRR Part 617 State Environmental Review Act (SEQRA) for the Project; and
WHEREAS, all work performed under this phase of the Capital Project involves the new construction of a new 16,315 square-foot facility off Paradies Lane in the Town of New Paltz and involves Ulster County’s Department of Emergency Services and Information Services Department Data Center in a one-story facility that will include an operations center that will be used as a command center as needed during disaster events and other regional emergencies, and
WHEREAS, aspects of the overall project also includes road and parking improvements, an extension of water services from the Town of New Paltz, a protective enclosure for emergency generator and other electrical equipment, rooftop PV array, and ground-source heating; and
WHEREAS, the Commissioner of Public Works requests that Capital Project No. 607 be amended to increase the funding available for construction services for the Government Operations Center in the amount of $29,636,289.00 for a total project cost of $34,927,063.00; and
WHEREAS, Resolution No. 536 of October 15, 2024 authorized the Chair of the Legislature to execute an agreement in the amount of $40,000.00 for the acceptance of a grant with New York State Department of State for Capital Project No. 607 – Government Operations Center for advanced radio equipment and technology; and
WHEREAS, as of December 31, 2024, there was a balance of $18,179,973.00, of which $571,650.00 has been authorized for appropriation with the adoption of Resolution No. 319 of June 18, 2024, leaving a current balance of $17,608,323.00; now, therefore be it
RESOLVED, the Ulster County Restricted Capital Reserve Fund for Capital Project No. 607 - Government Operations Center in the sum of seventeen million six hundred eight thousand three hundred twenty-three dollars ($17,608,323.00) will be used to fund construction services for the Ulster County Government Operations Center, and, be it further
RESOLVED, the Ulster County Restricted Capital Reserve Fund for Capital Project No. 607 – Government Operations Center is hereby declared closed upon the appropriation of funds authorized herein; and, be it further
RESOLVED, the Ulster County Commissioner of Finance is hereby directed to close the Ulster County Restricted Capital Reserve Fund for Capital Project No. 607 – Government Operations Center upon appropriating the funds authorized herein, and any remaining balance of the Fund including the allocation of interest earned by the Fund during the period ended December 31, 2025 is hereby unassigned; and, be it further
RESOLVED, that the 2025 Ulster County Operating Budget is hereby amended
as follows:
