Chairman of the Health, Human Services and Housing Committee, Abe Uchitelle, and Deputy Chair Craig Lopez offer the following:
WHEREAS, this resolution has been submitted by the County Executive on behalf of the Department of Health; and
WHEREAS, the Interim Public Health Director requests that the Chair of the Ulster County Legislature be authorized to execute a five-year contract (Contract No. DOH01-C40135GM-3450000) and any future amendments thereto, for the period of April 1, 2024 through March 31, 2029, in the amount of $338,250.00 with the New York State Department of Health to provide funds to continue the Tobacco Enforcement Program; and
WHEREAS, the contract provides for annual revenue in the amount of $67,650.00; and
WHEREAS, the Ulster County Department of Health will administer these funds utilizing the NYSDOH’s Environmental Health Information and Permitting System (eHIPS) to establish and enforce compliance checks for all tobacco retail dealers and vendors according to an established workplan, coordinate program education for new tobacco vendors and those who fail compliance checks, and establish and maintain all Clean Indoor Air Act related complaints, actions, investigations and enforcement; now, therefore, be it
RESOLVED, that the Chair of the Ulster County Legislature be authorized to execute a five-year contract (DOH01-C40135GM-3450000) and any future amendments thereto, for the period of April 1, 2024 through March 31, 2029, in the amount of $338,250.00 with the New York State Department of Health to provide funds to continue the Tobacco Enforcement Program, in the form as filed with the Clerk of the Ulster County Legislature or modified with the approval of the County Attorney; and, be it further
RESOLVED, that if funding for this program is eliminated, the Commissioner of Finance shall, immediately upon discovery, send written notification to the Clerk of the Legislature, and the relevant Department Head shall attend the next regular meeting of the Ways and Means Committee to assist the Committee in review and evaluation for determination of the program’s continuance,
and moves its adoption.
