Chairman of the ARPA Special Committee, Peter J. Criswell, Deputy Chair Thomas Corcoran, Jr., and Legislators Hewitt, Nolan, Petit, and Stewart offer the following:

 

WHEREAS, this resolution has been submitted at the request of the County Executive on behalf of the Department of Finance, Division of Recovery and Resilience; and

 

WHEREAS, the Ulster County Legislature passed Resolution No. 333 on August 17, 2021 creating Capital Project No. 602, entitled “ARP Infrastructure and Trails”; and

 

WHEREAS, a purpose of Capital Project No. 602 is to utilize federal American Rescue Plan Act (ARPA) funds for water and sewer infrastructure investments that assist economic development and affordable housing projects in Ulster County; and

 

WHEREAS, the Ulster County Housing Action Plan called for the County to increase the available inventory of transitional and supportive housing to break the cycle of homelessness in the County; and

 

WHEREAS, this extension of water and sewer infrastructure by the Town of Ulster would immediately benefit a planned redevelopment of the vacant Quality Inn & Suites hotel site (the “Project”) into supportive homeless housing; and

 

WHEREAS, the design for the sewer line to serve the Project indicates the need to provide for sewer service access via an easement over lands owned by Ulster County on NYS Route 28 further identified as New York State Real Property Tax Maps as Tax Parcel 48.14-1-22; and

 

WHEREAS, the extension of water and sewer infrastructure is a Type II Action under 6NYCRR Part 617 State Environmental Quality Review Act (SEQRA); now, therefore be it

 

 

 

RESOLVED, that the Ulster County Legislature determines that the granting of an easement necessary for the Project to proceed is a Type II Action under SEQRA and no further actions or determinations under SEQRA are required; and, be it further

 

RESOLVED, that the Chair of the Ulster County Legislature is hereby authorized to execute the required Easement and any necessary agreements or certifications, as filed with the Clerk of the Legislature and any amendments thereto as approved by the County Attorney and Legislative Counsel,

 

and move its adoption.
