Legislator Joe Maloney offers the following:
WHEREAS, Ulster County was awarded funding in the amount of $34,491,474.00 for the American Rescue Plan Act (ARPA); and
WHEREAS, the Ulster County Legislature has authorized and dedicated ARPA Projects in the amount of $34,353,626, leaving $137,847 of ARPA Funding unallocated to a specific purpose; and
WHEREAS, the Ulster County Legislature adopted Resolution No. 96 of 2022 authorizing $5,000,000.00 of ARPA funds for the Ulster County ARP Water and Sewer Infrastructure Program; and
WHEREAS, thirteen (13) municipalities were awarded a total of $4,641,554.00 under the ARP Water and Sewer Infrastructure Program, leaving a remaining amount of $358,446.00 of ARPA Water and Sewer funds unobligated; and
WHEREAS, the Ulster County Legislature adopted Resolution No. 167 of 2022 for the Demolition of the Former Ulster County Jail located on Golden Hill in the amount of $1,500,000.00; and
WHEREAS, the Demolition of the Former Ulster County Jail is now complete at a total cost of $1,364,900.00, leaving a total of $135,100.00 of ARPA Jail Demolition funds unobligated; and
WHEREAS, the Ulster County Legislature adopted Resolution No. 289 of 2022 authorizing $2,000,000.00 of ARPA funds for the Ulster County ARPA Parks Program; and
WHERAS, sixteen (16) municipalities have been awarded funding in the total amount of $1,543,865.00 under the ARPA Parks Program, leaving a remaining amount of $456,135.00 of APRA funds unobligated; and
WHERAS, the Legislature is currently considering the use of $419,079.00 from the ARPA Parks Program to reallocate funding to the ARP Small Business and Recovery Program, which if approved would leave a remaining amount of $37,056.00 of APRA Parks Program funds unobligated; and
WHEREAS, Ulster County has reported $14,031,357.00 in Total Estimated Revenue Loss to the U.S. Department of Treasury under the ARPA Revenue Loss Provision; and
WHEREAS, the Ulster County Legislature deems it necessary and appropriate to record ARPA Federal Aid in the amount of $668,449.00 for the provision of government services to the extend of revenue loss due to the COVID-19 pandemic; now, therefore be it
RESOLVED, that the 2023 Ulster County Capital Fundis hereby amended as follows:

RESOLVED, that the 2023 Ulster County Budgetis hereby amended as follows:
INCREASE AMOUNT
AA.1310.1079.3400.4095 Federal Aid, ARPA $668,449.00
DECREASE AMOUNT
AA.9900.9900-3700.9990 Appropriated Fund Balance $668,449.00
and, be it further
RESOLVED, that the Ulster County Commissioner of Finance is hereby authorized and directed to record revenue recognition in the amount of $668,449.00 for the receipt of Federal ARPA Funds due to Revenue Loss,
and moves its adoption.
