Referred to: The Public Health and Social Services Committee (Chairman Lopez and Legislators Bruno, Criswell, Petit, and Uchitelle), and The Ways and Means Committee (Chairwoman Archer and Legislators Bartels, Gavaris, Haynes, Maio, Ronk, and Walter)
Chairman of the Public Health and Social Services Committee, Craig V. Lopez, and Deputy Chair Peter J. Criswell offer the following:
WHEREAS, this resolution has been submitted by the County Executive on behalf of the Department of Social Services; and
WHEREAS, Sections A3-4 (Y) and A2-6(A)(3) of the Administrative Code provide that the Chair of the Ulster County Legislature can, upon approval of the County Legislature, enter into an inter-municipal agreement on behalf of the County of Ulster; and
WHEREAS, pursuant to General Municipal Law, Section 119-n(a), the definition of a municipal corporation includes a school district; and
WHEREAS, the Commissioner of the Ulster County Department of Social Services requests that the Chair of the Ulster County Legislature be authorized to execute Inter-Municipal Agreements with the Kingston City School District in the amount of $45,000.00 for the Preschool Special Education and Related Services Program (the “Program”), for the period September 1, 2020 through June 30, 2023; and
WHEREAS, the Program is an approved program under Section 4410 of New York State Education Law, which defines “special education itinerant services” and provides that such services shall include direct individual and/or group instruction to preschoolers with disabilities, by a certified special education teacher, as part of an approved program; now, therefore be it
RESOLVED, that the Chair of the Ulster County Legislature is authorized to execute inter-municipal agreements, and any amendments thereto, with Kingston City School District, in the amount of $45,000.00 for the Preschool Special Education and Related Services Program, for the period beginning September 1, 2020 through June 30, 2023, in the form as filed with the Clerk of the Ulster County Legislature, or as modified with the approval of the County Attorney,
and move its adoption.
