Supporting Notice Of Intent Of Ulster County To Serve As Lead Agency For The Removal Of The Mount Pleasant Bridge In The Town Of Shandaken – Department of Public Works

Chairwoman of the Public Works and Capital Projects Committee, Laura Petit, and Deputy Chair Dean J. Fabiano offer the following:

 

WHEREAS, this resolution has been submitted by the Acting County Executive on behalf of the Department of Public Works; and

 

 WHEREAS, the County owns the Mount Pleasant Bridge (the “Bridge”), which connects Mount Pleasant Road on the west bank of the Esopus Creek with New York State Route 212 on the opposite bank in the Town of Shandaken; and

 

 WHEREAS, the Bridge is in poor condition and is currently closed to vehicular and pedestrian traffic; and

 

WHEREAS, the Ulster County Legislature adopted Resolution No. 549 of 2016, which supported a grant application to the Catskill Watershed Corporation (“CWC”) for the removal of the Bridge (the “Project”); and

 

WHEREAS, the County was awarded the grant and entered into a contract with CWC in 2017 to begin the Project; and

 

WHEREAS, the proposed Project includes the removal of the Bridge constituting an Unlisted Action as defined under NYCRR Part 617.2(al) [SEQRA]; and

 

 WHEREAS, the County wishes to establish itself as lead agency and conduct a coordinated review as provided for in NYCRR Part 617.6; now, therefore, be it

 

RESOLVED, that pursuant to 6 NYCRR Part 617.6(b) (3) of the Regulations pertaining to Article 8 of the Environmental Conservation Law of New York State (SEQRA), the Ulster County Legislature hereby declares its intent to serve as Lead Agency for the Project; and, be it further

 

RESOLVED, that the Ulster County Legislature has determined, after review of the criteria contained in 6 NYCRR Parts 617.4 (b) and 6 NYCRR Parts 617.5(c), that the project is an Unlisted Action; and, be it further

 

 

 

RESOLVED, that the Ulster County Legislature will conduct a coordinated review and circulate its Notice of Intent to serve as Lead Agency, together with the EAF and accompanying documentation to all interested and involved agencies pursuant to 6 NYCRR Part 617.6(b) (2) (i) and 6 NYCRR Part 617.6(b) (3); and, be it further

 

RESOLVED, that pursuant to 6 NYCRR Part 617.6(b) (3), at the conclusion of an otherwise unchallenged thirty (30) day period following the date of transmittal of the Notice of Intent, the EAF and documentation aforesaid to the interested agencies, the Legislature shall become the Lead Agency under SEQRA for this project,

 

and move its adoption.
