Chairman of the Public Health and Social Services Committee, Craig V. Lopez, and

Deputy Chair Kathy Nolan offer the following:

 

WHEREAS, this resolution has been submitted by the County Executive

on behalf of the Department of Health; and

 WHEREAS, the Commissioner of Health requests that the Chairman of the

Ulster County Legislature be authorized to execute a five-year contract (Contract No.

DOH01-C33475GG-3450000) and any future amendments thereto, for the period of

April 1, 2018 through March 31, 2023, in the amount of $318,825 with the New

York State Department of Health to provide funds to continue the Tobacco

Enforcement Program; and

 WHEREAS, the contract provides for annual revenue in the amount of

$63,765; and

WHEREAS, the Ulster County Department of Health will administer these

funds utilizing the NYSDOH’s Environmental Health Information and Permitting

System (eHIPS) to establish and enforce compliance checks for all tobacco retail

dealers and vendors according to an established workplan, coordinate program

education for new tobacco vendors and those who fail compliance checks, and

establish and maintain all Clean Indoor Air Act related complaints, actions,

investigations and enforcement; now, therefore, be it

RESOLVED, that the Chairman of the Ulster County Legislature be

authorized to execute a five-year contract (DOH01-C33475GG-3450000) and any

future amendments thereto, for the period of April 1, 2018 through March 31, 2023,

in the amount of $318,825 with the New York State Department of Health to provide

funds to continue the Tobacco Enforcement Program, in the form as filed with the

Clerk of the Ulster County Legislature or modified with the approval of the County

Attorney; and, be it further

RESOLVED, if funding for this program is reduced or eliminated, the

program will be reduced accordingly or eliminated as well, 

 

and moves its adoption.
