Legislator Peter M. Loughran offers the following:

WHEREAS, the Ulster County Charter has charged the Ulster County

Legislature (the Legislature) with the responsibility of setting policy for the County

of Ulster; and

WHEREAS, the Legislature serves as a fiduciary of the public interest for

Ulster County; and

WHEREAS, in furtherance of its fiduciary responsibilities, the Legislature

actively seeks ways in which to maintain the fiscal health of Ulster County; and

WHEREAS, every year Ulster County must pursue In Rem Tax Foreclosure

proceedings to collect delinquent real property taxes; and

WHEREAS, each year a significant number of parcels are offered for sale at

the Ulster County Public Auction; and

WHEREAS, not all parcels that are offered for sale at the Public Auction are

sold; and

WHEREAS, those unsold parcels are held by Ulster County and no real

property taxes are collected thereon during the time the County is in title which

results in the loss of revenue that amounts to thousands of dollars annually; and

 

WHEREAS, the Legislature finds that adjacent property owners to the

properties without a presence of known environmental contamination that are not

sold at the Public Auction may be interested in the ownership of the parcels and,

therefore, may present another opportunity to get the parcels back on the tax rolls;

and

WHEREAS, the Legislature wishes to pursue this opportunity by advising

adjacent property owners of the availability of the unsold parcels; now therefore, be it 

 

RESOLVED, that every August, within one month prior to the Ulster

County Public Auction each year, the Ulster County Commissioner of Finance

shall send letters to property owners adjacent to those parcels that have not been sold

at the Public Auction advising that the property is are available for sale and the terms

under which the property maybe purchased,

and moves its adoption.

Legislator Loughran motioned, seconded by Legislator Donaldson, to amend the

RESOLVED by striking “every August” and “have not been sold at the Public

Auction advising that the property is” and inserting new language as indicated above

in bold font.
