Chairman Kenneth Ronk, Jr. and Legislators Belfiglio, Fabiano, Gerentine, Lapp,

Litts, Lopez, Maio, Maloney, R. Parete, Roberts, and Wawro offer the following:

WHEREAS, this resolution has been submitted by the County Executive on

behalf of the Personnel Department; and

WHEREAS, Sergeant Kerry Winters was a 31 year veteran of the Corrections

Division of the Ulster County Sheriff’s Office; and

WHEREAS, Sergeant Winters was trained across disciplines and was a

member of the Sheriff’s Office Water Rescue Team; and

WHEREAS, the Water Rescue Team is comprised of Deputies as well as

Corrections Officers; and

WHEREAS, Sergeant Winters died on September 22, 2016 while performing

a training exercise with the Water Rescue Team; and

WHEREAS, in 2015 a provision was added to the Ulster County Sheriff’s

PBA agreement that provided for 18 months of continued health insurance coverage

for the family of a Deputy who died in the line of duty; and

WHEREAS, since Sergeant Winters was a Corrections Officer as opposed to a

Deputy, he was not a member of the PBA and therefore not covered by that insurance

extension provision; and

WHEREAS, the Water Rescue Team represents a unique situation in that its

members perform the same life-saving functions but are covered by different labor

agreements and are therefore eligible for different benefits; and

WHEREAS, Sergeant Winters is survived by his wife and two sons; and

WHEREAS, it would be unjust in this unique situation to not extend the

insurance coverage provision to Sergeant Winter’s family; now, therefore, be it

RESOLVED, that the family of Sergeant Kerry Winters shall have the option

of electing health insurance coverage for a period of 18 months commencing when

this resolution is effective; and, be it further 

 

RESOLVED, that the administration of extending the health insurance

coverage be done consistent with that of the Ulster County Sheriff’s PBA,

and moves its adoption.
